Terms of Service

These terms govern your use of Tomara, operated by Smaks Enterprise. By creating an account you agree to them. If you do not agree, please do not use the service.

What Tomara is — and isn’t

Tomara is a self-development tool that helps you reflect on and grow across the areas of your life. It is not therapy, counselling, or medical care, and it does not provide medical, psychological, or professional advice. Nothing in the app — including anything the AI coach says — is a substitute for a qualified professional. If you are in crisis or experiencing persistent low mood, please contact a health professional or a crisis line.

Eligibility & your account

You must be 18 or older. You are responsible for keeping your login secure and for activity under your account. Provide accurate information and keep it up to date.

Plans, trial & billing

• New accounts include a 14-day free trial with full Pro access; no card is required to start.
• Paid plans are billed monthly in South African Rand (ZAR) through PayFast: Pro R499/month and Executive R999/month. Prices may change with notice.
• Paid plans are recurring subscriptions that renew automatically each month via PayFast until you cancel. The first payment is taken upfront; the next charge is one month later, and monthly thereafter.
• You can cancel anytime from Plan & Billing. Cancellation stops future charges; you keep access until the end of the period already paid for, after which your account returns to the Free tier (your data is retained). Except where required by law, payments already made are non-refundable — contact us if something went wrong and we’ll deal with it fairly.

Acceptable use

Don’t misuse the service: no attempts to breach security, no automated scraping, no unlawful content, and no use that infringes others’ rights. We may suspend accounts that do.

Your content

You own what you create in Tomara. You grant us the limited licence needed to store and process it to provide the service (including sending coach context to our AI provider to generate replies). See our Privacy Policy.

Availability & disclaimers

We work hard to keep Tomara running but provide it “as is” without warranties of uninterrupted or error-free operation. To the fullest extent permitted by law, Smaks Enterprise is not liable for indirect or consequential loss, and our total liability is limited to the amount you paid us in the three months before the claim.

Governing law

These terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction.
